Patientenmobilität und grenzüberschreitende Gesundheitsversorgung sind alltägliche Phänomene in der Europäischen Union (EU). Im Jahr 2011 hat die EU eine Richtlinie erlassen, um in diesem Kontext Rechtssicherheit herzustellen. Bisher gibt es keine umfassenden systematischen Studien über ethische Aspekte grenzübergreifender Gesundheitsversorgung. In dieser Arbeit werden die rechtlichen Entwicklungen der grenzübergreifenden Gesundheitsversorgung dargestellt und die in der Literatur vereinzelt erwähnten ethisch relevanten Aspekte heuristisch und auf Patiententypologien aufbauend systematisch inventarisiert und diskutiert. Es zeigt sich, dass die Möglichkeit der Patientenmobilität und die damit vor (...) allem verbundenen Finanzierungsregelungen die Autonomie einiger Patienten sicherlich verbessern kann. Allerdings können wohl nicht alle Patienten Versorgungsverbesserungen erwarten. Empirische Daten belegen, dass die moderne Geburtsmedizin Schwangerschaft und Gebären vorrangig als krankhaft wahrnimmt, was zu einem Legitimationsdefizit führt: Eine primär invasive Geburtsmedizin verletzt das Prinzip der Nichtschädigung, verursacht vermeidbare Kosten und ist nicht ohne weiteres durch das Autonomieprinzip gedeckt. Von den unmittelbar Beteiligten ist diese Pathologisierung als eine solche jedoch kaum wahrgenommen worden. Daher stellt sich die Frage, wie es zur sozialen Akzeptanz einer derart drastischen Wahrnehmungsverschiebung kommen konnte. Da Begriffe unsere Wahrnehmung strukturieren, interessiert uns vor allem die konzeptionelle (...) Dimension dieser geburtsmedizinischen Verkehrung des Normalen ins Krankhafte, die in einer Reflexion auf die zwei Quellen legitimen ärztlichen Handelns erkennbar wird. Sowohl der Krankheitsbegriff als auch das moderne Verständnis von Selbstbestimmung weisen eine interne Unschärfe auf, die pathologisierende Tendenzen begünstigt. Der moderne Krankheitsbegriff erschwert eine klare Abgrenzung zwischen krank und gesund. Und Autonomie ist ein mehrdeutiges Konzept, das in einer spezifischen Auslegung die Pathologisierung fördert. Da beide Konzepte ärztliches Handeln rechtfertigen, bleibt ihr delegitimierendes Potential in der Praxis unscheinbar. Erst reflexiv und polylogisch lässt sich dieser blinde Fleck beobachten, so dass eine Korrektur der Pathologisierung möglich wird. (shrink)

Graeco-Arabic studies, or the study of the translations of classical Greek works into Arabic during the early ‘Abbāsid caliphate of the Arabs (ca. 750–1000), is a field that is well known; it has been cultivated, with significant results for the study of medieval Islamic civilization, for more than a century and a half now. What is less well known is the opposite trend of translations from Arabic into (Byzantine) Greek, which began after the Photian renaissance — as a direct result, (...) I have claimed, of the Graeco-Arabic translation movement — and is of comparable significance for the study of Byzantine civilization. For reasons that it might be interesting to investigate at some point, Byzantinists have shied away from Arabo-Greek studies, to the great detriment of a deepened study of Byzantine writings, especially the scientific literature. The book by Dr. Hélène Condylis under review here, a study of the Greek translation of the famous Arabic book of fables Kalīla wa-Dimna (originally of Indian provenance), finally breaks open this unduly neglected area and makes a most impressive first contribution to Arabo-Greek studies that will, in years to come, be considered as pioneering. The authority of the early sacred Buddhist texts was decided during the six great Buddhist Councils called for at different periods of time by the Buddha’s disciples after passing into Parinirvana. Theravada Buddhism accepts only the teachings of the Buddha that were declared authoritative during these councils. This early canon includes the discourses of the Buddha (Sutta), the rules for the monastic order (Vinaya), and the higher philosophical teachings (Abhidhamma). While Mahayana Buddhism accepts this early canon, it also accepts and emphasizes other sacred texts, called Sutras, which they believe were also taught by the Buddha. Within Mahayana there arose another tradition called Vajrayana that accepts the canons of both Theravada and Mahayana and adds a new literature called the Tantras, which present Buddhist esoteric teachings. Common to these traditions are the precepts for living the teachings of the Buddha and the authoritative commentaries of the particular traditions. The rapid spread of judicially-enforced constitutional rights has been one of the most dramatic developments in modern law. This book argues that there is now a global model for how such rights should function, and develops an original, philosophically grounded, account of their nature and scope.

In this collection of original essays on metaethics, the nature of morality, and the structure of moral reasoning are characterized, the limits of justification in ethics are examined, and the underlying rationale of moral philosophy is probed. Around mid-century metaethics held centre stage in discussions of moral philosophy in Anglo-American and Scandinavian philosophical environments. During the 1970s, its "foundational" position was challenged by developments within analytic philosophy itself by a renewal of systematic substantive ethics largely, but not exclusively, of a (...) Rawlsian inspiration and by a reinvigorated interest in substantive moral problems on the part of philosophers. However, as work went on here, philosophers encountered problems concerning the methods of moral reasoning and the structure of justification of moral claims that were recognized to be metaethical. This led to a renewal of metaethics now freed from its previously narrow linguistic focus and aprioristic restrictions. The last two decades have witnessed a wide-ranging and global discussion of the theory and structure of human and constitutional rights. This debate initially focused on the principle of proportionality and subsequently on the related ideas of the ‘culture of justification’ and the ‘right to justification.’ There is now a far-reaching agreement that both proportionality and justification in human and constitutional rights law are concerned with the reasonableness, alternatively the justification in terms of public reason, of the act under consideration. In the jurisprudence of constitutional courts around the world, there is an emerging trend towards an autonomy-based understanding of constitutional rights: increasingly, rights are interpreted as being about enabling people to live autonomous lives, rather than disabling the state in certain ways. This article investigates the conception of autonomy employed by courts by presenting two candidates and examining which of them explains the current practice of constitutional rights law better. The first, labelled the excluded reasons conception of autonomy, claims that (...) a person’s autonomy is violated if he is treated on the basis of certain impermissible—in particular, moralistic or paternalistic—reasons. It is concluded that, while this is a coherent understanding of autonomy, it cannot explain many of the rights that are widely accepted today. The second, the protected interests conception, argues that a person has autonomy interests in controlling certain domains of her life, and offers a scale on which the importance of the various autonomy interests can be assessed. The article demonstrates that this conception is coherent and adequately explains the current practice. The final section briefly explores some implications of this result for a comprehensive reconstructive theory of constitutional rights. (shrink)

Noted philosopher Kai Nielsen offers an answer to this fundamental question - a question that reaches in to grasp at the very heart of ethics itself. A primary goal of research in the semantics/pragmatics interface is to investigate the division of labor between the truth-conditional component of the meaning of an expression and other factors of a more pragmatic nature. One favorite strategy, associated foremost with Grice (1967, 1989), is to keep to a rather austere semantics and to derive the overall meaning of an utterance by predictable additional inferences, called ``implicatures,'' which are seen as based on certain principles of rational and purposeful interaction. This study investigates switching costs in landmark-based wayfinding using olfactory and visual landmark information. It has already been demonstrated that there seem to be no switching costs, in terms of correct route decisions, when switching between acoustically and visually presented landmarks. Olfaction, on the other hand, is not extensively focused on in landmark-based wayfinding thus far, especially with respect to modality switching. The goal of this work is to empirically test and compare visual and olfactory landmark information with regard to (...) their suitability for wayfinding including a modality switch. To investigate this, an experiment within a virtual environment was conducted in which participants were walked along a virtual route of 12 intersections. At each intersection, landmark information together with directional information was presented, which was to be memorized and recalled in the following phase, either in the same or in the other modality. The results of the study show that, in contrast to the no-switching costs between auditory and visual landmarks in previous studies, switching costs occur when switching modality from visual to olfactory and vice versa. This is indicated by both longer decision times and fewer correct decisions. This means that a modality switch involving olfactory landmark information is possible but could lead to poorer performance. Therefore, olfaction may still be valuable for landmark-based-wayfinding. We argue that the poorer performance in the switching-condition is possibly due to higher cognitive load and the separate initial processing of odors and images in different cognitive systems. We investigate and compare two major approaches to enhancing the expressive capacities of modal languages, namely the addition of subjunctive markers on the one hand, and the addition of scope-bearing actuality operators, on the other. It turns out that the subjunctive marker approach is not only every bit as versatile as the actuality operator approach, but that it in fact outperforms its rival in the context of cross-world predication.

The starting point of this chapter is the uncontroversial assumption that the right to defend the innocent against unjust aggression is limited to the infliction of necessary harm and is further limited to the infliction of proportionate harm. The aim of the chapter is to shed light on the nature and location of those limits. The chapter is divided into three sections. In the first section it is argued that both unnecessary and disproportionate defense infringe upon the rights of an (...) unjust aggressor. The final two sections address, respectively, the questions of where the boundary between necessary and unnecessary defense is located and of where the boundary between proportionate and disproportionate defense is located. Those questions turn out to be more complicated than is often noticed, and the answers reached in these sections are novel ones. (shrink)

Free will is one of the oldest and most debated topics in the history of philosophy. Both positivist philosophy and humanist philosophy considered the problem of free will to be the most difficult issues to untangle. In recent years, psychologists have begun to apply the methods of empirical science to study the psychological mechanism, impact and expression of free will. The general consensus is that free will is an illusion, but people still believe in its existence. Free will has been (...) found closely related to moral responsibility, moral behavior, creativity, self-esteem and subjective well-being. Future research should define free will in more psychological sense, and to explore the generation mechanism and function of free will in everyday life. In book X of the Republic, Plato famously reports “a quarrel between poetry and philosophy.” The present essay examines this quarrel in book X, along with other relevant parts of the Republic, by understanding “philosophy” and “poetry” as rival ways of life and rival ways of discourse. The essay first explains why, in Plato’s view, poetic discourse weakens one’s power to reason and is at odds with philosophic discourse. Then it shows how poetic discourse is bound up with a way (...) of life that champions the value of freedom. Such a life forms a contrast with the philosophic life, which is marked more by stability and unity than by freedom. The quarrel, however, is not a simple antagonism. The essay hence concludes by discussing why, despite the opposition between the two, philosophy cannot do without poetry. (shrink)
